ESC compliance matter – Background

In 2025, the Essential Services Commission (ESC), the regulator of the Victorian Energy Upgrades (VEU) program, undertook a review of Opt Energy’s activity 36 installations involving pre-rinse spray valve. The review addressed technical classifications for certain installations within this activity category.
Following its review, the ESC decided to not register Victorian Energy Efficiency Certificates (VEECs) associated with activity 36 pre-rinse spray valves due to its interpretation of the relevant legislation.

Scope of the matter

This matter relates specifically to activity 36 installations involving pre-rinse spray valves under the VEU program.
Given the ESC’s 2025 interpretation of the legislation, Opt Energy does not currently undertake installations in this activity. Opt Energy instead focuses on its broader offerings including solar systems, battery storage, heat pump hot water systems, and air conditioning installations which it continues to deliver to an exemplary standard in accordance with the applicable legislation and program requirements.

Our response and legal review

Opt Energy maintains the activity 36 activities occurred in accordance with the legislation applicable at the time of the installations and the installations resulted in energy abatement for consumers as required by the VEU program.
Accordingly, Opt Energy has sought an external review of the decision. The review is yet to be determined.
